Terms of Service

Welcome to DirectKick. These Terms of Service ("Terms") govern your access to and use of the DirectKick platform, including our website, mobile application, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to create an account and use the Service. DirectKick is designed for use by adult coaches, team administrators, and parents. The Service is not intended for direct use by children under 13 years of age.
2. Account Registration and Security
To use the Service, you must register with a valid email address and create a personal identification number (PIN). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. Permitted Use
The Service is provided for the purpose of managing youth sports teams, including but not limited to: roster management, practice planning, game day operations, team communication, and player development tracking. You agree to use the Service only for its intended purpose and in compliance with all applicable laws and regulations.
You agree not to:
- Use the Service for any unlawful purpose
- Share inappropriate, offensive, or harmful content
- Attempt to gain unauthorized access to the Service or other users' accounts
- Use the Service to harass, bully, or intimidate any person
- Interfere with or disrupt the Service or servers connected to the Service
- Use automated systems or bots to access the Service without authorization
4. Coach Responsibility for Player Data
As a coach or team administrator, you may input information about players on your team, including names, jersey numbers, positions, and parent or guardian contact information. By entering this information, you represent and warrant that:
- You have obtained appropriate consent from each player's parent or legal guardian before entering their child's information into the Service
- You have authorization to enter parent or guardian contact information for the purpose of team communication
- You will use player and parent information only for legitimate team management purposes
- You will promptly update or remove information when requested by a parent or guardian
You agree to indemnify and hold DirectKick harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your failure to obtain required consent before entering player or parent data into the Service.
5. Photos and Media
The Service allows you to upload photos during games and practices. These photos may contain images of minor children. By uploading photos, you represent that you have obtained appropriate consent from the parents or guardians of any minors depicted. You are solely responsible for ensuring compliance with applicable laws regarding the photography and sharing of images of minors.
Photos you upload may be processed by our AI provider (Anthropic) for tactical analysis features such as formation detection and coaching suggestions. Photo processing is subject to the AI provider's data usage policies.
6. Voice and Audio Recordings
The Service allows you to capture voice notes and audio recordings during games and practices. By using these features, you acknowledge that you are solely responsible for compliance with all applicable recording consent laws, including state laws that may require the consent of all parties being recorded. Massachusetts, where DirectKick is based, requires the consent of all parties to a recording. DirectKick is not responsible for any legal consequences arising from your use of voice or audio recording features.
7. AI-Powered Features
The Service includes AI-powered features such as game plan generation, practice planning suggestions, and coaching advice. These features are powered by third-party artificial intelligence technology (Anthropic Claude). You acknowledge and agree that:
- AI-generated content is provided for informational and educational purposes only
- AI suggestions are not a substitute for professional coaching certification, training, or judgment
- AI output may contain inaccuracies and should be reviewed before use
- Team data (roster, schedule, results) may be processed by the AI provider to generate suggestions, subject to the provider's data usage policies
8. User Content and Team Communication
You are responsible for all content you post, share, or transmit through the Service, including team chat messages, game notes, and announcements. You retain ownership of your original content (practice plans, notes, analyses) but grant DirectKick a non-exclusive, worldwide, royalty-free license to use, store, and display such content as necessary to operate and provide the Service to you.
9. Intellectual Property
The Service, including its design, features, and content (excluding user content), is owned by DirectKick and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our express written permission.
10. Termination
Either party may terminate this agreement at any time. You may stop using the Service and request deletion of your account by contacting us. We may suspend or terminate your access to the Service if you violate these Terms or engage in conduct that we determine to be harmful to the Service, other users, or third parties. Upon termination, your right to use the Service will immediately cease. Upon termination and your request, we will delete your personal data in accordance with our Privacy Policy.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DirectKick DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DirectKick SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY ARISING OUT OF YOUR USE OF THE SERVICE. DirectKick IS NOT RESPONSIBLE FOR ANY COACHING OUTCOMES, GAME RESULTS, OR PLAYER INJURIES THAT MAY OCCUR IN CONNECTION WITH ACTIVITIES MANAGED THROUGH THE SERVICE.
IN NO EVENT SHALL DirectKick'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DirectKick IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Massachusetts.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and DirectKick regarding the Service and supersede all prior agreements and understandings.
16. Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. DirectKick may assign its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through an in-app notice. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
